Here is the text from the netconf protocol draft:

       merge: The configuration data identified by the element
       containing this attribute is merged with the configuration
       at the corresponding level in the configuration datastore
       identified by the target parameter.

I do not think this "merge" is the same thing as "install this
configuration that worked yesterday". (Unless merge does also
mean to remove everything already configured on the box, in
which case the name seems to be misleading.)

Huh? I did not propose to redefine XML standards.

I do fail to understand why creating something new for all netconf
boxes instead of subsetting XPATH only for small devices will at 
the end be a winning situation.
