We are going into the territory of network neutrality... ISP should not filter anything except if this filtering has been agreed upfront - this also includes, that user is behaving according to AUP ... If user is violating AUP e.g. sending out spam or scanning net, then ISP can act... No blind port tcp/25 filtering....
