If there is no agreement on what the problem is that needs solving,
its hard to see how the WG should be chartered to actually solve the
problem. Hence, the charter doesn't allow solution  development until
there is some level of agreement on a problem statement.

The whole point of a problem statement is that if there is agreement
as to what the problem is, there is some hope for how to address
it. But if folk don't even agree on what the problem is or if it is
worth solving....
